This paper explores the marginalized practice of sportswriting to demonstrate the limited ways in which the question "who is a journalist?" has been answered within the profession. Following John Dewey and Raymond Williams, we offer an alternative view of democratic culture that values narrative as well as information. We also discuss how "New Journalists" (and other writers since), in their quest for fresh, sophisticated storytelling strategies, turned to sports as a cultural activity worthy of serious examination. Our goal is to (...) demonstrate that sportswriting fundamentally resembles other forms of reporting and that journalism should not use sports as an ethical straw man against which to defend the virtue of its serious work. This suspension of our usual ethical judgments would deepen our sense of the moral significance of sportswriting and allow us to rethink journalism's relation to democratic culture in productive new ways. How can I know something? How can I convince someone of the rightness of my position? How does reality function? What is artistic creativity? What is the role of the state? It is well known that people from various cultures give dissimilar answers to such philosophical questions. After three decades in the cross-cultural study of ideas and values, Thomas Kasulis found that culture influences not only the answers to these questions, but often how one arrives at the answers. In (...) generalizing cultural difference, Kasulis identifies two kinds of orientation: intimacy and integrity. Both determine how we think about relations among people and among things, and each is reasonable, effective, and consistent. Yet the two are so incompatible in their basic assumptions that they cannot successfully engage each other. Cultural difference extends beyond nations. Cultural identities crystallize in relation to religion, occupation, race, gender, class. Rather than attempt to transcend cultural difference, Kasulis urges a deeper awareness of its roots by moving beyond mere cultural relativism toward a cultural bi-orientationality that will allow us to adapt ourselves to different cultural contexts as the situation demands. Wonderfully clear and unburdened by jargon, Intimacy or Integrity is accessible to readers from a variety of perspectives and backgrounds. By analyzing the synergy between thought and culture, it increases our understanding of cultural difference and guides us in developing strategies for dealing with orientations different from our own. This article attempts to spell out more clearly the Thomist, the Openist, and the Molinist approaches to divine providence, and to indicate the strengths and weaknesses of these three positions. It begins by discussing both the traditional notion of divine providence and the libertarian picture of freedom. The article then argues that each theory of divine providence has its advantages and disadvantages. Each has had numerous able and creative defenders. As with most philosophical disputes, one can hardly expect this debate (...) to come to an end. The field of battle may shift more clearly in the coming years to considerations of which view, when applied to specific doctrines, offers us the most satisfying overall position. Considered the first significant teacher of rhetoric in America, John Witherspoon also introduced Scottish moral philosophy in America, and as president of Princeton reformed the curriculum to give emphasis to both studies. He was an active pamphleteer on religious and political issues and a signer of the Declaration of Independence. Thomas P Miller argues that Witherspoon’s career exemplifies the Ciceronian ideal, and the eight selections Miller presents from the 1802 American edition of the _Works _corroborate that claim.

There is no arguing the impact of Inoue Tetsujirō on the development of philosophy in Japan from the Meiji Restoration through the end of the Pacific War. He was the first Japanese to receive a doctorate in philosophy from Germany and the first native-born chair of the philosophy department at Tokyo Imperial University, the training center for almost all the major Japanese philosophers who graduated before 1915. Inoue was instrumental in making German idealism the Western philosophy of choice for Japan, (...) but he also appreciated Asian traditions as well, having no qualms about claiming there was true philosophy in India, China, and premodern Japan. He set the foundation for academic philosophy in Japan not so much through his own rather simplistic personal philosophy, but especially through his contributions to the organization of the field. This article focuses mainly on Inoue’s troubled relation with Confucianism. On one hand, in seeking a premodern philosophy to serve as the bedrock for modern Japan, Inoue looked to the Edo-period Confucian traditions originating in China. He divided them into Shushigaku, Yōmeigaku, and what he named Kogaku, the school focusing on classical texts preceding neo-Confucian developments and interpretations. In many respects, like so many others of his generation, Inoue was by training and personal preference a Confucian. That is not the whole story, however. Inoue understood Confucianism’s primary purpose as cultivating the social values and order that would ensure an efficient society of human flourishing, stability, and harmony. Yet, he also likely suspected that the people of the new Japan, with its modernization and plethora of Western ideas, would not unquestioningly accept the authority of the Confucian classics, nor be willing to undertake the rigors of textual study that are the hallmark of the Confucian scholar. In Edo-period Japan, that study had been the responsibility of the samurai class, but in their democratization program, the Meiji reformers had abolished the old class system. Education of the young would now shift from the Confucian academies to the new public school system. Always cooperative with the government to the point of being obsequious, Inoue took a leading role in the National Morality program and its installment in the nationwide school curriculum. That curriculum combined a Shinto-based reverence for the sacred nature of the emperor in the kokutai ideology along with practical moralistic values that could be loosely called Confucian. Yet, if schooling for most was limited to the elementary level and if there was no longer a samurai class to oversee the moral behavior of the society, who could nurture and enforce the moral order? Through a set of fortuitous events, Inoue “discovered” bushidō, the Way of the warrior. If there were no longer a samurai warrior class, perhaps all Japanese could become de facto samurai—at least in their mindset. Most may no longer have the scholarly skills and time to glean their spiritual and moral insights from Confucian texts. Yet, they could find the virtues of loyalty, sincerity, filiality, and compliance with seniority within the distinctively mindful heart and spirit of ancient Japan carried within the Japanese bloodline. What happened to the Confucianism of Inoue Tetsujirō? Some of its values were absorbed into bushidō and National Morality, but the praxis of the Confucian scholar and the ideal of the kunshi seem to have been lost, much to Japan’s detriment. (shrink)

A perceived national emergency creates the temptation to abandon principled constraints to official action in order to pursue whatever is thought necessary to confront the crisis. Principled constraints are thought good precisely when they are least needed - during normal times - and thought obstructionist when they are most needed to guide and constrain official action - during times of perceived exceptional circumstances. We are accustomed to thinking of constitutional rights not as absolutes, but as subject to balancing against compelling (...) governmental need. When compelling government interest is expressed in terms of necessity, otherwise prohibited actions, such as torture, may be justified in specific circumstances. In this Article, I argue that we should reject the temptation to rely on necessity to justify extralegal responses to emergencies. Moreover, we should also reject the claim that the Constitution contains a core principle of necessity that frees executive officials to act unfettered by other constitutional constraints under some circumstances. One problem with necessity is that it displaces constitutional commitments to constrained action because necessity, not constitutional principle, becomes the ultimate authority for official action. A second problem with necessity is that when it is used to justify the practice of torture, it undermines the liberal conception of the person that grounds the political legitimacy of the State. Finally, when we prioritize necessity, we change how we look at the world in ways that have pervasive legal and cultural consequences for how we employ other constitutional rights. When we rely on necessity to override principled commitments, such as the prohibition against torture, we change our practices and principles, creating the conditions for changing fundamental aspects of our constitutional culture. I argue that although it is always subject to change, our constitutional culture does not support a worldview that legitimates treating persons as objects of torture, and that arguments to change our culture in light of the needs of necessity are insufficient. The first half of the twentieth century was a dark time for philosophical theology. Sharp divisions were developing among philosophers over the proper aims and ambitions for philosophical theorizing and proper methods for approaching philosophical problems. But many philosophers were united in thinking, for different reasons, that the methods of philosophy are incapable of putting us in touch with theoretically interesting truths about God.

The Oxford Handbook of Philosophical Theology attempts both to familiarize readers with the directions in which the scholarship of this discipline has gone and to pursue the discussion into hitherto under-examined areas. Philosophical theology is aimed primarily at theoretical understanding of the nature and attributes of God and of God's relationship to the world and its inhabitants. During the twentieth century, much of the philosophical community (both in the Anglo-American analytic tradition and in Continental circles) had grave doubts about our (...) ability to attain any such understanding. In recent years the analytic tradition in particular has moved beyond the biases that placed obstacles in the way of the pursuing questions located at the interface of philosophy and religion. Written by some of the leading scholars in the field, the articles in the book are grouped into five sections. In the first section, articles focus on the authority of scripture and tradition, on the nature and mechanisms of divine revelation, on the relation between religion and science, and on theology and mystery. The next section focuses on philosophical problems connected with the central divine attributes: aseity, omnipotence, omniscience, and the like. In the third section, articles explore theories of divine action and divine providence, questions about petitionary prayer, problems about divine authority and God's relationship to morality and moral standards, and various formulations of and responses to the problem of evil. Traditional Christians face a puzzle concerning the freedom and perfection of Christ. Jesus the man, it seems, must have possessed significant freedom forhim to serve as a moral example for us and for his death to have been truly meritorious. Yet Jesus the Son of God must be incapable of sinning if he is trulydivine. So if Jesus is both human and divine, one of these two attributes - significant freedom or moral perfection - apparently needs to be surrendered. If the postmodern is a collage--as some critics have suggested--or if collage is itself a kernel of the postmodern, what does this mean for our way of understanding the world? _The Frame and the Mirror_ uses this question to probe the distinctive question of the postmodern situation and the philosophical problem of representation.

From the perspective of free speech theory, both of the central First Amendment values - human autonomy and deliberative democracy - require robust protection for the places and spaces in which speech and public discourse occur. This Article argues that current Supreme Court doctrine does not effectively protect speech from content neutral regulation of place. The problem is that remaining neutral is consistent with policies that would dislocate the very place for the “marketplace of ideas.” Moreover, free speech theory focused (...) on autonomy and deliberative democracy has not adequately addressed the role that place plays in furthering these values. Speech may be, and increasingly in practice is, suppressed by control of the places and spaces where speech occurs. Limitations on public expressions critical of administration policies at Presidential events is a key example of the regulation of speech through the regulation of place. Dissent is increasingly displaced with the consequence that the figure of dissent risks disappearing from public discourse. Employing aspects of Hanna Arendt's political philosophy, this Article argues that we need to re-think and re-articulate the importance of public places for our free speech tradition. Personhood and human autonomy, as well as robust public debate, can only exist and develop in fullest form within social structures that provide public places and spaces for human interaction and discourse. Fundamentally, as Arendt suggests, we protect public appearances for public discourse not simply for its instrumental value for deliberation, but for the intrinsic value of creating persons and citizens in their fullest form. Contrary to the legend that evolved in late sixteenth century Recusant More hagiography, of a distancing or even a breach in the spiritual and intellectual friendship between Thomas More and Erasmus of Rotterdam, the primary texts point to the persistence of an intimate bond between them. Even More's late letter to Erasmus informing him of his resignation addresses the matter of Erasmus's churchmanship and doctrinal reliability. Here we find More defending and praising the writings of Erasmus, and not merely (...) against the rabid and ill-willed scholastic ignoramuses who had attacked his New Testament translation, but even against morally upright and well-meaning ecclesiastical scholars, who had failed to remove the beam from their own eyes before hypocritically endeavoring to pluck the speck out of Erasmus's. Thomas More adhered to the commendation of Erasmus published by Pope Leo X, and whether More's modern admirers like it or not, Thomas More remained for two decades Erasmus's first and best apologist. Crocker I MORAL PHILOSOPHY has languished long within the confines of something like the following purported dilemma: either moral discourse is the discourse of principles and rules rationally grounded, or moral discourse is the discourse of passions and personal preferences, clothed in the garments of rational justification. Alasdair (...) MacIntyre's disquieting suggestion—that our language of moral debate is nothing more than the "simulacra of morality"—provides a grim outlook for moral philosophy. 1 Indeed, when moral inquiry is conducted in terms of ethical theory, without independent grounds upon which competing arguments can meet, philosophical discourse, embedded in competing theories, seems to be only so much cacophonous clamor, rationally convincing no one except those who already accept the terms employed by their own theory. One way to avoid this philosophical effluvium produced by moral philosophy is to follow Ludwig Wittgenstein in rejecting the very terms upon which it is made (the distinction between the particular perspective and the universal standpoint), recognizing that moral inquiry begins from where we already are—the everyday world in which we find ourselves.Towards the end of avoidance here, I wish to add to this simmering background of ethical discord Mark Twain's story of The Adventures of Huckleberry Finn. 2 Twain's controversial voice provides a place for moral thinking unavailable through strictly theoretical discourse. 3 And reading Huck and Jim's story through the philosophical avoidance of Wittgenstein's latent ethical thought provides the transformative possibility of seeing the domain of the ethical in a new light. 4 [End Page 57]Although Twain boldly states at the beginning of his novel that "persons attempting to find a moral in it will be banished," 5 he does show us without the need of theory or dogma how a change in one's way of seeing is intertwined with a change in one's way of living; this connection between ways of seeing and ways of living makes possible a kind of moral transformation that characterizes the change in Huck's perception of Jim, from that of a slave to that of a friend. This moral conversion is much like the perceptual transformations that Ludwig Wittgenstein considers in his discussions of "noticing an aspect," 6 in which a shift in what one sees is connected to the background against which the perceptual object is seen and to the ways in which one is prepared to respond to it. When confronting perceptual ambiguity, as in the case of Jastrow's ambiguous duck/rabbit figure, one looks to the context and background to clarify what one sees, just as one does with semantic ambiguity. In coming to see in one way or the other, nothing is explicitly stated, nothing is put into argumentative form. And in Twain's narrative, we are not given arguments for why we should see Jim as human, nor does the narrative recount Huck's confrontations with moral arguments; rather, through his interactions with Jim, Huck is shown Jim's humanity, his friendship, and we, the readers, are shown the possibility of a moral transformation that is not determined by or grounded in rules or philosophical arguments.The moral realist might agree that such a transformation could be motivated in ways other than rational arguments, but to be legitimate, it must be possible to reconstruct the transformation according to rational considerations. The ability to "get behind" the transformation in some justificatory way is what I am denying here (as is Wittgenstein); for what one finds when one "gets behind" is another situated language game that is itself not open to question (though it could be if we direct our attention towards it). A half century ago electronic fetal monitoring was rushed into clinical use with the promise that the secrets of fetal heart rate decelerations had been discovered and that the newly discovered knowledge would prevent cerebral palsy with just in time cesarean sections preventing babies from experiencing asphyxia, which was thought to be the primary cause of cerebral palsy. In the years since electronic fetal monitoring’s debut, it has been discovered that asphyxia is a rare cause of cerebral palsy. At the (...) same time electronic fetal monitoring use increased to 85% of all labors, the C-section rate increased to 33% without an attributable decrease in the rate of cerebral palsy. What went wrong with electronic fetal monitoring? The answer lies in a new analysis of the physiologic theories concerning fetal heart rate decelerations, demonstrating that the earlier electronic fetal monitoring theories were wrong. Nineteenth-century spiritism was a blend of religious elements, the philosophy of mind, science and popular science and contacts with extraterrestrials were a commonplace phenomenon during spiritistic séances. Using the example of Carl du Prel I show how his comprehensive mystic philosophy originated in a theory of extraterrestrial life. Carl du Prel used a Darwinian and monistic framework, theories of the unconscious and a Neo-Kantian epistemology to formulate a philosophy of astronomy and extraterrestrial life. He claimed that the mechanism of Darwinian (...) selection is responsible for the distribution of stars and the orbits of the planets. In his speculations on the nature of extraterrestrial life he used the concept of organ projection to argue that technical solutions on earth will be realized organically on other planets and claimed that superior extraterrestrials have quantitatively and qualitatively different senses and thus different forms of intuition. A comparison with Camille Flammarion, spiritist and populariser of astronomy, demonstrates the contextual complexities of spiritism. In contrast to du Prel’s sober Neo-Kantian philosophical speculations, Flammarion was a late proponent of a French esoteric tradition that was rooted in romantic socialism, painted grand cosmological vistas and emphasized reincarnation. I put forward the hypothesis that current discourses on extraterrestrial life are affected by the spiritist tradition mainly through the ‘Golden Age’ science fiction literature of the 1940s and 50s and its successors. However, neither Carl du Prel nor Camille Flammarion contributed significantly to this tradition, which is mainly shaped by the psychical research of J. B.
